Terms of Service

These terms apply to Commenterra, a service for understanding public discussion under online videos. They explain what the Service does, what you agree to when you use it, and how plans and billing work.

This page is maintained in English only. The rest of the app follows the language you choose in the header.

1. Acceptance of these terms

By creating an account or using Commenterra (the “Service”), you agree to these terms. If you do not agree with them, please do not use the Service.

2. About the Service

Commenterra helps you understand the discussion around a public online video. You give it a link to a public video; it collects the publicly available comments on that video and organises them into a result you can read and explore — a summary of the video, topic groupings, sentiment, a visual map of the discussion, and the comments themselves.

The Service only reads public information. It never posts, replies, edits, moderates, likes, hides or deletes anything on the video platform, it does not access private or account-only information there, and it does not ask you to connect a channel of your own.

3. Accounts

  • You need an account to run an analysis. You can register with an email address and password, confirmed by a short code we email you, or sign in with a Google account.
  • Use an address you control and keep your account details accurate. Activity through your account is treated as yours, so keep your password to yourself and tell us promptly if you think someone else has access.
  • One account per person. Do not create additional accounts to obtain the free allowance more than once.
  • You must be old enough to enter into a contract where you live. The Service is not directed at children.

4. Acceptable use

You agree not to:

  • use the Service unlawfully, or to infringe anyone’s rights;
  • use results to target, harass or retaliate against an individual commenter;
  • circumvent usage limits or billing controls, including by sharing accounts to pool allowances;
  • attempt unauthorised access to the Service, to other accounts, or to analyses that are not yours;
  • disrupt or overload the Service, or automate it outside the interfaces we provide;
  • resell the Service or present it as your own product.

5. Public content and analysis

You may submit links to public videos for analysis. The Service retrieves and processes the publicly available information needed to produce the result you asked for, including video details, comments and replies.

That content belongs to the people and organisations who created it, not to us and not to you. We claim no rights in it, and nothing here grants you any. Source content can change or disappear at any time, and an analysis is a snapshot of the moment it was produced.

Commenterra is an independent service. It is not affiliated with, endorsed by or sponsored by any video platform, and platform names and trademarks belong to their respective owners. Your use of material from a platform remains subject to that platform’s own terms.

6. Automated results

Results are produced in part by automated analysis. Counts are counted, but summaries, topics, sentiment, importance and the way comments are matched to moments of a video are interpretations. They can be incomplete, miss context or simply be wrong — sarcasm, irony and slang are the usual places — and they may change as the Service improves.

Treat results as a starting point for your own reading rather than as established fact, and do not make decisions about an individual person on the strength of them. How you use the information is your responsibility.

7. Plans and usage limits

The Service is offered on a free plan and on paid plans. Each plan includes an allowance of analyses per billing period, and plans differ in how much of a discussion a single analysis collects. Current plans, prices and allowances are shown on the Pricing page, which is the authoritative source for them.

  • Allowances are per billing period and do not carry over. Unused analyses expire when a new period begins.
  • An analysis that fails or is cancelled before producing a result is returned to your allowance. One that finishes, including with a partial result, counts as used.
  • An account runs one analysis at a time. Starting a new one ends any unfinished analysis and returns its allowance.
  • Allowances are a measure of usage, not currency. They cannot be bought, sold, transferred or exchanged for cash, except where the law requires otherwise.
  • We may restrict or suspend accounts that attempt to work around these limits.

Plans and limits can change. Where a change affects a paid plan, it takes effect from your next billing period rather than inside one you have already paid for.

8. Subscriptions and payments

Paid plans are subscriptions. You are billed the price and on the billing period shown at checkout, and the subscription renews automatically until you cancel.

  • Payments are handled by our authorised payment and billing provider, Paddle, which acts as merchant of record for the sale. We do not receive or store full payment card details.
  • Applicable taxes are determined and handled at checkout based on your location.
  • You can cancel or manage your subscription at any time from the billing controls on the Pricing page.
  • Cancelling stops future renewals. Paid access continues until the end of the period you have already paid for, after which the account returns to the free plan.
  • If a payment fails or a subscription lapses, paid features stop and the account returns to the free plan.

9. Refunds

Refund requests are handled case by case, in line with the purchase terms shown at checkout, our payment provider’s policies, and any refund rights you have under consumer law where you live — which apply whatever this page says. To request one, contact us from the address on the account (see section 16).

10. Intellectual property

The Service — its software, interface, branding and the way results are presented — belongs to us and is protected by law. Using the Service does not transfer any ownership of it to you.

Third-party content analysed through the Service remains the property of its owners. You may use the output of your own analyses, including in your work, subject to those owners’ rights and to the terms of the platform the content came from.

11. Availability and changes to the Service

We may add, change, limit or remove features, and the Service may be unavailable at times — for maintenance, for reasons outside our control, or because a platform or provider the Service depends on is unavailable. We do not promise uninterrupted availability, and we may suspend or discontinue the Service. Where a change affects a period you have already paid for, we will take that into account.

12. Disclaimer

To the extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind. Analysis results are informational. The Service is not professional advice, and nothing in it should be relied on as such.

13. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, or loss of data arising from your use of the Service, and our total liability in connection with the Service is limited to the amount you paid us for it in the twelve months before the claim arose.

Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.

14. Suspension and termination

You can stop using the Service at any time, cancel a subscription from the billing controls, and ask us to delete your account — see the Privacy Policy for what deletion covers.

We may suspend or close an account that breaches these terms, or that is involved in abuse, fraud, or attempts to circumvent limits or security, or where the law requires it. Where it is reasonable to warn first, we will. Any mandatory rights you have as a consumer are unaffected.

15. Changes to these terms

We may update these terms. The “Last updated” date at the top of this page changes when we do, and we will give reasonable notice of material changes to registered users. Continuing to use the Service after a change means you accept the updated terms.
